Terms & Conditions
OVERVIEW
These terms and conditions govern your use of the Gem Sanctum website (gemsanctum.com) and any purchase you make through it. By using this site or placing an order, you agree to be bound by these terms.
Gem Sanctum is operated by Khay Oberon, trading as Gem Sanctum, based in Auckland, New Zealand. All transactions are governed by New Zealand law.
PRODUCTS & ORDERING
ll products listed on this site are made to order unless explicitly stated otherwise. Product images are representative — because each piece is handcrafted with natural gemstones, slight variations in colour, pattern, and dimensions are inherent and expected. These variations are not defects.
By placing an order, you confirm that:
- You are at least 18 years of age
- The information you provide is accurate and complete
- You authorise payment for the total order amount
PRICING & CURRENCY
All prices are displayed in New Zealand Dollars (NZD) unless otherwise indicated. Prices include GST for New Zealand customers. For international customers, local import duties, taxes, and customs charges may apply depending on your country's regulations — except for USA customers, where import duties are included in the displayed price (DDP shipping).
We reserve the right to adjust pricing at any time. Price changes will not affect orders that have already been confirmed.
GEMSTONES & MATERIALS
All gemstones supplied by Gem Sanctum are accompanied by appropriate certification or documentation. Natural gemstones may exhibit inclusions, colour zoning, or other natural characteristics — these are features of genuine stones, not flaws.
Any treatment applied to a gemstone (such as heat treatment) will be disclosed in the product listing and on the accompanying certificate.
Metal purity (e.g. 9ct, 14ct, 18ct gold, 950 platinum) is as stated in the product description. All metals are sourced from certified suppliers.
MADE-TO-ORDER & LEAD TIMES
Most products are made to order with an approximate lead time of 21 working days from order confirmation. Bespoke commissions (custom designs) have a lead time of 6–10 weeks depending on complexity.
You will receive progress updates during the making process. Final sign-off on design details is required before manufacturing begins for bespoke commissions.
Lead times are estimates and may vary due to material sourcing, workshop capacity, or unforeseen circumstances. We will notify you promptly if a significant delay occurs.
PAYMENT
Payment is processed securely through Wix Payments at the time of order. We accept major credit and debit cards.
For bespoke commissions, a deposit may be required to begin work. The deposit amount and payment schedule will be agreed upon before work commences. Deposits for bespoke commissions are non-refundable once design work or material sourcing has begun.
SHIPPING & DELIVERY
Orders of $750 NZD or more ship free worldwide via DHL Express — tracked, insured, and signature-required. Orders under $750 NZD are shipped via NZ Post International Tracked at a flat rate: $15 NZD within New Zealand, $32 NZD to North America, Australia, UK, and the EU, and $42 NZD to the rest of the world. All shipments include tracking and insurance.
Risk of loss passes to you upon delivery. A signature is required for all deliveries. If a delivery cannot be completed, the courier will make further attempts or hold the parcel at a local depot.

RETURNS & EXCHANGES
Made-to-order and bespoke items are not eligible for return unless they arrive damaged or materially different from what was described.
We offer a free ring resize within 30 days of delivery — see our Returns Policy page for full details.
If your item arrives damaged or with a manufacturing defect, contact us within 7 days of receipt. We will arrange a return, repair, or replacement at our cost.
LIFETIME WARRANTY
Every Gem Sanctum ring is covered by a lifetime structural warranty against manufacturing defects. This covers prong failure, setting defects, and structural issues arising from normal wear. It does not cover damage from misuse, accidental impact, or unauthorised modifications.

INTELLECTUAL PROPERTY
All content on this site — including text, images, designs, logos, and custom element code — is the intellectual property of Gem Sanctum and may not be reproduced, distributed, or used without written permission.
Product designs created as bespoke commissions remain the intellectual property of Gem Sanctum unless otherwise agreed in writing. You receive full ownership of the physical piece.
LIMITATION OF LIABILITY
To the maximum extent permitted by New Zealand law, Gem Sanctum's liability for any claim arising from a purchase is limited to the price paid for the product in question. We are not liable for indirect, incidental, or consequential damages.
Nothing in these terms excludes or limits liability that cannot be excluded under the New Zealand Consumer Guarantees Act 1993.
DISPUTES
Any dispute arising from these terms or a purchase will be governed by the laws of New Zealand and subject to the jurisdiction of the New Zealand courts.
We encourage you to contact us directly before pursuing any formal dispute resolution. Most issues can be resolved quickly through open communication.
PRIVACY
Your personal information is collected, used, and stored in accordance with our Privacy Policy. By using this site, you consent to the practices described in that policy.
CHANGES TO THESE TERMS
We may update these terms from time to time. Changes will be posted on this page with a revised date. Continued use of the site after changes constitutes acceptance of the updated terms.
